INTRODUCTION

All people of the world have been given the right to self-determination by the Creator. This principle is now commonly embraced by the global world political community that it is the founding premise for the Wolastoqiyik Nation and the Wabanaki Confederacy as a spiritual covenant on Civil and Political Rights. Today, the First Peoples and all their descendants on Turtle Island, after a struggle over many generations, effectively demand to be the makers of their destiny.

The citizens of the Wolastoqiyik Nation of the eastern door claim control and jurisdiction over those matters which are regarded as internal and territorial to the citizens not in a sense of ownership but rather in a sense of occupation.

The citizens of the Wolastoqiyik Nation also claim effective control over those resources which belong to the Nation by virtue of original jurisdiction given to them by the Creator.

Furthermore, the citizens of the Wolastoqiyik Nation also declare that their relationship as a Nation to other Nations will be based on their original jurisdiction which defines their inherent rights, a just interpretation of the treaty process and other agreements in which we, from time to time, entered or will enter with representatives of other Nations under the Wabanaki Confederacy member of the Great Confederacy of all the Nations on Turtle Island.

WOLASTOQIYIK NATION

The Wolastoqiyik Nation is composed of family clans that form 8 communities or Tribes of Wolastoqiyik citizens sharing their communal sentiments and united through shared history and cultural heritage and language within a political and spiritual system. The Wolastoqiyik Nation cannot be subjugated to other Nations, as each Nation is a unique web of people, values and historical experiences.

The history of the Wolastoqiyik Nation is unique in the sense that all the citizens of the Wolastoqiyik Nation experience sovereignty in practice. The Wolastoqiyik were never subjugated to human central government as such which determined the destiny of all the citizens. However, the citizens maintained a common bond with other Tribes or Nations through upholding the Creator's Laws through original jurisdiction according to their customs, traditions and values, through a common language and through covenants, sacred ceremonies, wampum belts and treaties with other Nations.


As a Nation with a history of covenants, wampum belts and treaties, the Wolastoqiyik have always valued peaceful and reasonable relationships. The same holds true in the history of our relationship with the newcomers, the French and British, to our lands when we invited them under our original jurisdiction to join the Great Eastern Confederacy of our Nations in 1701 and in 1752 and 1759.

THE SOVEREIGNTY OF THE WOLASTOQIYIK NATION

The fundamental reality underlying this charter for self-determination is that the citizens of the Wolastoqiyik Nation joined as a Nation with other Nations in a territorial structure, as it deems necessary and will exercise full political and spiritual authority over the territory provided to them by the Creator. Our Nation is sovereign in determining its future.

The treaty process, essentially is a recognition of our original jurisdiction to sovereignty. Implicitly, there were representatives of sovereign Nations which deliberated and negotiated the treaties of 1701, 1752, 1759 and many other treaties in the eastern part of Turtle Island.

Therefore, the sovereignty principle underpins this constitution under the Creator's gift of our original jurisdiction. The Wolastoqiyik Nation is a sovereign entity which regulates its internal and territorial affairs. Our relationships with other peoples will therefore be based on a Nation to Nation principle.

ORIGINAL JURISDICTION

The Maliseet Nation is constituted upon the principle of original jurisdiction to self-determination. The original jurisdiction of the Wolastoqiyik Nation is based upon the inherent rights in its definition of itself and what spiritual and material rights and resources that come under its proprietorship.

The true fact for the Wolastoqiyik Nation is that our original jurisdiction is based upon our relation with the Creator. Our inherent rights are given to us by the Creator and are expressed and exercised through the citizens.

All sovereign Nations and governments have come into being because of the inherent right to do so. The Wolastoqiyik Nation is based upon the same principle and we proclaim and declare under our original jurisdiction that we do have the inherent right to sovereignty, to nationhood and to govern and take care of ourselves while at the same time respecting other sovereign Nations and governments. The Wolastoqiyik Nation will therefore exercise its original jurisdiction with its corresponding responsibilities and obligations.


SACRED TREATY

All our ancestors representing the Tribes of the Wolastoqiyik Nation entered into treaties with representatives of other Nations including the Nations of the newcomers on Turtle Island in 1701 and 1752. The citizens did not concede their original jurisdiction through the treaty making process. However, the treaty making process is a sacred and living testament of the existence of our original jurisdiction.

The spirit and intent of the treaty was fundamentally one of peaceful co-existence. We agreed to share the land, up to a depth of six inches with the newcomers to our land in order that they too would survive. Our ancestors understood the sacredness of the land and life in general. Land was not a commodity to be sold or given away. We were placed on our lands on Turtle Island by the Creator and we were given stewardship over Mother Earth.

The citizens of the Wolastoqiyik Nation proclaim and declare that they never relinquished any rights to the land and its resources. They will continue to use the land and its resources as they have done in the past.

Our sacred treaties are therefore implicit in this sacred hospitable gesture of the Wolastoqiyik. The Elders continue to reaffirm their commitment to these treaties with its corresponding obligations.

PART I: A DECLARATION OF THE WOLASTOQIYIK NATION

We the citizens of the Wolastoqiyik Nation recognize and declare:

that the Laws of the Creator are the only supreme Laws of the Wolastoqiyik ;

that the Creator gave us our spiritual beliefs, our language, our culture and a place on Mother Earth which provided us with all our needs for our existence and sustenance;

that we know the Creator placed us here;

that the Creator gave us our Laws that govern all our relationships to live in harmony with Mother Earth, Nature and Humanity;

that the Laws of the Creator define our original jurisdiction, our inherent rights, responsibilities and obligations;

that we continue to exercise our original jurisdiction to fulfil our responsibilities and obligations given to us by the Creator for the lands upon which we were placed;

that the original jurisdiction, responsibilities and obligations given to us by the Creator cannot be altered or taken away by any other Nation;

that we have maintained sovereignty, tribal and nationhood government, territory, oral history, culture, language, and our customs and traditions from time immemorial;

that within our territorial lands given to us by the Creator, that the Government of the citizens of the Wolastoqiyik Nation will exercise its sovereign inherent rights, responsibilities and obligations;

that the Government of the Wolastoqiyik Nation through authority by the citizens, will exercise complete jurisdiction upon its territorial ancestral lands, its resources, its air space and waters, its citizens and their corresponding corporate entities, organizations services and programs;

that the Government of the Wolastoqiyik t Nation will be financially supported through the resources of Mother Earth provided by the Creator;

that the Government of the Wolastoqiyik Nation with its respective original jurisdiction, inherent rights, responsibilities and obligations shall be guided by the Creator's Laws;

that the Creator granted rightful stewardship of Mother Earth and its resources to the First Peoples on Turtle Island; and

that the original jurisdiction, inherent rights, responsibilities and obligations given to us by the Creator are non-negotiable with any Nation or anyone.

PART II: BILL OF RIGHTS

2.1 Creator's Laws

The Creator's Laws are the guiding principles of our original jurisdiction, our inherent rights, responsibilities and obligations. The seven teachings of the Wolastoqiyik which are hereby confirmed, accepted and ratified as the basis of our relationships, practices and laws:

2.1.3 Honesty, truth

2.1.4 Faith, strength

2.1.5 Wisdom

2.1.6 Knowledge

2.1.7 Caring, sharing

2.2.8 Collective rights

2.2.1 Inherent rights

Our original jurisdiction includes our inherent right to sovereignty, nationhood and to govern or to take care of ourselves as well as our special relationship to the land, resources and other people and Nations. All these rights spell out other self evident, naturally occurring given rights by the Creator. Inherent rights also include all those rights exercised in our traditional societies.

2.2 .3Sacred Treaty Rights

Our sacred Treaty is basically a recognition and confirmation of our original jurisdiction. Because of the treaties, our people maintain a special relationship with other Nations as one Crown and the Crown of the English people and the Crown of the French people on a Nation to Nation basis. The Crown of the Wolastoqiyik Nation still maintains the right to enter into treaties with other Nations.

Some of the responsibilities and obligations confirmed in the treaties include education, health, economic development, fishing and trapping, trust obligation and financial arrangements of the Nations that enter into treaty with the Wolastoqiyik Nation, political and bilateral relations, co-existence between parties and to treaty benefits as stated reserving lands and resources.

2.2.3 Environment rights

The Wolastoqiyik Nation hereby recognizes, affirms and ratifies the original jurisdiction of the Wolastoqiyik to be stewards of the environment upon the ancestral territories given to us by the Creator to occupy for our protection and our preservation.

2.2.4 Resource rights

The Wolastoqiyik Nation hereby recognizes, affirms and ratifies the original jurisdiction of our people to access, use, benefit, trade from the resources provided by Mother Earth.

2.2.5 Universal rights

The Wolastoqiyik Nation herby recognizes, affirms and ratifies the original jurisdiction to universal rights of the Wolastoqiyik to humanitarian services which include social assistance, education, employment, unemployment insurance, health, economics, to enter universities and security and protection.

2.3 Individual Rights

The individual rights of the citizens of the Wolastoqiyik Nation include the following:

2.3.1 The right to speak the Wolastoqiyik t language.

2.3.2 The right to security from violence.

2.3.3 The right to be treated fairly before the law.

2.3.4 The right to personal freedom and mobility.

2.3.5 The right to freedom of belief and expression.

2.3.6 The right to freedom of speech and expression.

2.3.7 The right to peaceful association and assembly.

2.3.8 The right to property and land.

2.3.9 The right to vote in tribal, national and confederate elections in accordance with Tribal, National and Confederate Election Codes or on Referendum.

2.3.10 The right to access public information.

2.3.11 The right to privacy and confidentiality.

2.3.12 The right to be treated humanely and with respect.

2.4 Elders Rights

The Elders of the Wolastoqiyik Nation will maintain the right to special respect in accordance with customary practice.

2.5 Underprivileged and the Disabled

The underprivileged and the disabled of the Wolastoqiyik Nation shall retain the right to receive priority of the fundamentals of survival.


PART 3: WOLASTOQIYIK NATION, NATIONAL ,COMMUNITY AND TRIBAL GOVERNMENT


3.1 Political Rights and Authority

3.1.1 The Wolastoqiyik Nation has always been a political unit for the citizens and their Communities. Their original jurisdiction to exercise nationhood and sovereignty has never been relinquished. All political power is inherent within the citizens and with their communities governments founded on their authority. The Government of the Maliseet Nation is therefore based on the principle of a Government by the Wolastoqiyik, of the Wolastoqiyik and for the Wolastoqiyik.

3.1.2 The Government of the Wolastoqiyik Nation is the sovereign authority through which the citizens manifest their will, issue their direction and conduct their affairs.


3.2 Responsibilities and Obligations of Governments

The Government of the Wolastoqiyik Nation through the Grand Council of the Wolastoqiyik Nation exercises the following responsibilities and obligations with and through their communities Tribal governments:

3.2.1 To deal with other Nations Governments inclusive of each Tribe of theWolastoqiyik Nation, international governments and the federal crown of Canada and their respective political on a bilateral basis.

3.2.2 To represent all political issues of the Wolastoqiyik Nation.

3.2.3 To be an official advocate and voice of the Wolastoqiyik Nation.

3.2.4 To introduce and pass tribal and national laws for the Wolastoqiyik Nation.

3.2.5 To cause agreements through negotiations which will enhance the position of the Wolastoqiyikt Nation.

3.2.6 To ensure the protection of and enhance the inherent rights, sacred treaty rights, responsibilities and obligations, and the constitutional rights of the Wolastoqiyikcitizens.

3.2.7 To ensure economic and financial development of the Wolastoqiyik Nation in the goal toward self-sufficiency and efficiency.

3.2.8 To ensure the development of proper administrative departments for the Wolastoqiyik Nation at the community tribal and national level.

3.2.9 To expand and promote the overall jurisdiction and best interest of the Wolastoqiyik Nation.

3.2.10 To be accountable to the citizens of the Wolastoqiyik Nation.


3.3 Original Jurisdiction

The Government of the Wolastoqiyik Nation exercises jurisdiction on the following areas:

3.3.1 For all the MWolastoqiyik citizens and communities.

3.3.2 For all establishments regardless of location, including organizations, corporate entities, programs and services.

3.3.3 For and on all territorial ancestral lands.

3.3.4 For all waters on territorial ancestral lands.

3.3.5 For all resources on territorial ancestral lands.

3.3.6 For all airspace above territorial ancestral lands.

3.3.7 For all jurisdictions which are shared or overlapping with other jurisdictions as per arrangements with other Nations and Governments.

3.4 Wolastoqiyik Nation, National and community Tribal structures

3.4.1 The structure of Government of the Wolastoqiyik Nation with its accompanying establishment consists of diagram 1 and 2 as per attachment.

3.4.2 The Government of the Wolastoqiyik Nation is comprised of a Grand Council composed of Sachems, and Sagamo. Each one is chosen by the qualified Maliseet citizens of each of the community Tribes of the Wolastoqiyik Nation for as long as their respective Tribal term of office.

3.4.3 One National Grand Sachem which is elected by the whole of the citizens of the Wolastoqiyik Nation and exercises the following duties:

3.4.3.1 effects all meetings of the Government of the Wolastoqiyik Nation,
3.4.3.2 acts as official spokesperson of the Government of the Wolastoqiyik Nation,
3.4.3.3 organizes the formation of Government operations with respect to the various community tribal representatives,
3.4.3.4 acts as chairperson of the Government of the Wolastoqiyik Nation sessions,
3.4.3.5 votes to break all ties.


3.5 Term of office for the National Sachem ,community Tribal Sachems and Sagamo

3.5.1 The National Sachem is elected for a four year term of office.

3.5.2 The Tribal Sachems are elected for a term prescribed by each of the Election Codes of each of the community Tribes.

3.5.3 The Tribal Sagamo are elected for a term prescribed by each of the Election Codes of each of the community Tribes.

3.6 Elections

3.6.1 National Sachem

All the citizens of the Wolastoqiyik Nation who are 18 years of age on the date of the election are eligible to vote or run for the position of National Sachem.

Election to the National Sachem will be handled by an impartial Electoral Officer appointed by the Tribal Sachems of the Grand Council of the Wolastoqiyik and subject to an Election Code prescribed and approved in consensus at general assembly of the citizens of the Wolastoqiyik Nation in each of the Tribe's community.

3.6.2 Tribal Sachems and Sagamo

All the citizens of the Wolastoqiyik Nation who are 18 years of age on the date of the election are eligible to vote or run for the position of Tribal Sachem or Sagamo.

All the citizens of the Maliseet Nation who are 18 years of age on the date of the election can only vote or run in their respective community of their respective Tribe.

Elections to Tribal Sachems and Sagamo will be handled by an impartial Electoral Officer appointed by the Maliseet Tribal Government and subject to an Election Code approved in consensus at a general assembly of the Maliseet of that Tribe.

3.7 Oath of Allegiance

All the representatives elected to the Wolastoqiyik national and communnity tribal Governments will make an oath of allegiance to the Wolastoqiyik Nation Constitution and the Wolastoqiyik Citizenship as soon as possible after the date of the election. The oath of allegiance shall be arranged by the Electoral Officer and will include a feast and dialoguing of a specific mandate with the Elders of the community Tribes. Such a mandate will be consistent with the term of the Wolastoqiyik Nation Constitution.


3.8 Wolastoqiyik Nation, National and community Tribal Governments sessions

3.8.1 National and community Tribal sessions will be held at least 4 times per year at a place to facilitate the presence of the citizens of the Wolastoqiyik Nation.

3.8.2 A quorum in the Grand National Council representing the Wolastoqiyik National Government session shall consist of 8 community Tribal representatives not to include the National Sachem.

3.8.3 A quorum in the Wolastoqiyik Tribal Governments sessions shall be established by each of the Tribal Governments according to the number of Sagamo elected.

3.8.4 All decisions of the Wolastoqiyik Nation National and community Tribal Governments require the consent of a quorum for passage with the exception of Laws.

3.8.5 All items, issues, bills and so forth shall require a period of debate and /or question and answer period upon introduction and before a vote is taken.

3.8.6 Any representative who is absent from national and community tribal Government sessions forfeit his/her vote to the majority side in decision making. This ruling will not apply to emergency sessions with a notice of less than 1 week in advance.

3.8.7 Adequate notice of at least one week in advance will be given to representatives of any National or Tribal Government sessions to occur.

3.9 Recall

3.9.1 An individual representative of the National or Tribal Government will be subject to recall at any time for any of the following reasons:

3.9.1.1 embezzlement or fraud
3.9.1.2 abuse of position and power
3.9.1.3 a criminal offence
3.9.1.4 serious breach of the Wolastoqiyik Nation Constitution

3.9.2 In the event of a recall, a factual statement will be registered with the Council of the Elders and if required with an independent Chief of Justice who shall cause an impartial investigation to occur. The Council of Elders shall declare the position concerned either vacant or in operation at community Tribal General Assembly upon the conclusion of the investigation.

3.9.3 Any person who is recalled will not be eligible to run for any of the Wolastoqiyik Government positions for at least 10 years or as prescribed by the community Tribes.

3.10 Vacancies

In the event of any vacancy, the position should be put up for by-election within one month of the vacancy occurring.

PART 4: ESTABLISHMENTS

4.1 National General Assembly

A National General Assembly will be held at least once a year as a form of gathering and as prescribed by the representatives of the National Government of the Wolastoqiyik Nation at a place central and accessible to all the citizens of the Wolastoqiyik Nation, on the Wolastoqiyik ancestral territory for the purpose of:

4.1.1 Accountability to all the citizens of the Wolastoqiyik Nation.

4.1.2 Review the Nations Laws, concerns and to seek national direction.

4.1.3 Public information and education purposes on matters that are of importance to all the citizens of the Wolastoqiyik Nation.

4.2 Community Tribal General Assembly

A Community Tribal General Assembly will be held at least once every season or four times per year for the purpose of:

4.2.1 Accountability to the citizens of the community Tribe.

4.2.2 Review the Tribal Laws, concerns and to seek Tribal direction.

4.2.3 Public information and educational purposes on matters that are of importance to all the citizens of the community Tribes.


4.3 National and Community Tribal Special Councils

4.3.1 Special Tribal Councils will be established from the citizens at large for consultation and advisory purposes and will include:

4.3.1.1 an Elders Council
4.3.1.2 a womens council
4.3.1.3 a mens council
4.3.1.4 a youth council

4.3.2 National Special Councils will be established for each category from the Tribal representatives.

4.3.3 National Special Council meetings will be held at least once every season or four times per year.

4.3.4 Tribal Special Council meetings will be held at the discretion of each councils representatives.


4.5 National and Community Tribal Legislation

The process for ratification or repeal of the Wolastoqiyik Nation Laws shall include the following:

4.5.1 Recommendations from the Tribal Council and /or General Assembly, Clan Meeting, administrative meeting.

4.5.2 Preparation of draft by legal advisors and/or technicians.

4.5.3 Review by the Justice Commission for submission to the Wolastoqiyik Nation Government.

4.5.4 First reading and review, debate and rejection or ratification by each of the Tribal councils by consensus.

4.5.5 Notification to each of the Tribes.

4.5.6 Second reading and review, debate and rejection or ratification by the National Council.


4.6 Justice System

A Justice Commission shall be established by the Wolastoqiyik Nation Government to rule on all the ancestral territorial lands for a four year term to review impending laws for ratification by the Wolastoqiyik Government through a Government order with a specified mandate which will include:

4.6.1 To act as a Supreme Court.

4.6.2 To oversee the operation of the justice system.

4.6.3 To deal with appeals and enforce justice

4.6.4 The justice system will be independent from the political affairs of the Wolastoqiyik Nation and subject to a Justice Code.

4.6.5 A Chief Justice with other magistrates shall be appointed by the Wolastoqiyik Nation Government for four year term.

4.6.6 The justice system will include a Peacemaker's court and a process of appeal.

4.7 Public Administration

4.7.1 A public Administration department and other department organisations or corporations will be established to handle the administrative affairs, programs and services for the Wolastoqiyik Nation and shall receive their legal capacity through the National and Tribal Governments for theWolastoqiyik Nation in accordance with Wolastoqiyik Nation Laws.

4.7.2 The primary purpose of any board or commission is the shaping of policies for particular programs, services or organisations.

4.7.3 A Public Administration, Labour Laws and Corporations Act and all other pertinent Executive and Administrative Laws shall be enacted.

4.7.4 All Boards and those Commissions specified by Government order shall be subject to democratic elections for a term of up to two years.

4.7.5 The Government of the Wolastoqiyik Nation may create commissions by appointment for emergency purposes.

PART 5: RELATED MATTERS

5.1 Citizenship

5.1.1 A Citizenship Code shall be enacted prescribing the general Laws of citizenship and immigration and shall not be developed according to the Indian Act.

5.1.2 The Citizenship Code of the Wolastoqiyik Nation will be based primarily on those who have family ties to the existing citizens and other provisions shall be enacted according to customs and ruled by the Council of Elders of each community Tribe.

5.1.3 Anyone Applying for citizenship will need the endorsement of at least 2 members of the Community Council of Elders.

5.2 Land and properties

5.2.1 A Land and Properties Act shall be enacted regulating lands and properties of the Wolastoqiyik Nation.

5.2.2 All the land of the Wolastoqiyik Nation shall be held for the Common good of it's citizenship through the Government of the Wolastoqiyik Nation.

5.2.3 No land under the jurisdiction of the Wolastoqiyik Nation shall be sold leased or rented to a non citizen of the Maliseet Nation without a Tribal or National Referendum.

5.3 Economics

5.3.1 The Government of the Wolastoqiyik Nation will endeavour continuously to achieve the goal of self-sufficiency for its citizenship through:

5.3.1.1 trade
5.3.1.2 investments
5.3.1.3 manufacturing ventures
5.3.1.4 business enterprises
5.3.1.5 creation of employment
5.3.1.6 distribution system
5.3.1.7 tapping into and creating marketing systems
5.3.1.8 gaming and lotteries
5.3.1.9 monopolizing traditional commodities, products and industries
5.3.1.10 environmental and resource development
5.3.1.11 other economical ventures which serve the best interests of the Maliseet Nation

5.4 Laws of Application

5.4.1 Any Law which is inconsistent with the Constitution of theWolastoqiyik Nation shall be deemed to be of no force or effect.

5.4.2 All Laws of force and effect in the WolastoqiyikNation shall be ratified by the Government of the Wolastoqiyik Nation and are subject to treaty agreements with other Nations.

5.5 Taxation

5.5.1 The Government of the Wolastoqiyik Nation shall maintain the prerogative to negotiate and levy taxes on foreign or external entities for their use of natural resources, land, air, water, and others.

5.5.2 Any internal taxation shall be based on the principles of negotiations and consultations with the citizens for the purposes of subsidizing programs and services and creating employment, as the principle of taxation is not new to the citizens. This was present at one time in the form of sharing, offerings and gift giving according to our tradition.

5.6 Finance

5.6.1 The Wolastoqiyik Nation, through its Government, reserves the right to fiscal arrangements with other Nations or with the Canadian Government as per fiduciary obligations.

5.6.2 Financial budget reports shall be submitted at each General community Tribal and National Assembly.

5.6.3 A Finance Commission shall monitor overall fiscal expenditures which shall include all programs and organizations under the jurisdiction of the Wolastoqiyik Nation at the National and community Tribal level.

5.6.4 Expenditure of budgets shall be done with the appropriations made by National or community Tribal laws or policies.

5.6.5 An annual audit shall be submitted to the citizens.

5.7 Referendum

5.7.1 It shall be the responsibility of the Government of the Wolastoqiyik Nation to cause Tribal or National Referendum on any contention issues with the exception of those mandatory items mentioned in this constitution.

5.7.2 Each Referendum will disclose the appropriate information to the citizens of the Wolastoqiyik Nation, at least two months in advance of the date set for the Referendum.

5.7.3 All Referendums must receive a majority vote of those casting ballots in order to be declared effective.

5.7.4 Referendums shall become effective upon final ratification by the Government of the Wolastoqiyik Nation.

5.8 Flag

5.8.1 All public institutions of the Wolastoqiyik Nation will exhibit the legal flag of the Wolastoqiyik Nation.

5.8.2 The flag must receive endorsement of all the citizens of the Wolastoqiyik Nation through the process of a Referendum in order to be legal.

PART 6: AMENDMENT FORMULA

All amendments to the Constitution of the Wolastoqiyik Nation will be subject to the referendum process for endorsement.
